Title IX 2024 - THIS HAS BEEN POSTPONED
We are postponing the Title IX training until further notice due to the following:
On July 24th, a federal court issued a temporary injunction affecting all public schools in North Dakota. This injunction prevents the U.S. Dept. of Education from implementing the new 2024 Title IX regulations in North Dakota until the case is resolved. The main issue involves the definition of “sex” and “sex discrimination” and whether Title IX covers gender identity. As a result, the DOE cannot enforce the entire 2024 rule, including parts that eased procedural requirements for Title IX complaints.
What this means:
For now, continue using the previous All Staff Nondiscrimination and Anti-Harassment (AAC) Training, along with the policies AAC and AAC-BR2 you've been using for the past few years, if you find them useful.
We will monitor developments to ensure the training remains appropriate and accurate. This is a temporary injunction, and the case will be fully ruled on later. An appeal may also be filed, which could change the injunction and affect future actions.
You do not need to be a NDCEL member to register for this training.
Title IX Training
When: Wednesday, August 14, 2024, 9:00am-12:00pm (Postponed)
Virtual: Zoom link on Wed, August 14th, where you can join live. This option will give you the opportunity to interact with Laura Booth of Ratwik, Roszak & Maloney, P.A. and ask any questions you may have.
Recorded Option: Recording will be available from August 14th - Saturday, September 14th, 2024 at midnight. (No exceptions)
Cost: $250 per school district, as many people as needed from your district may view the recording, from August 14- September 14, 2024.
Content: The new regulations for 2024 require that separate individuals be trained, one designated for each of the different roles. Every school district must have at least 4 (FOUR) individuals trained.
Each district must identify (at least) four separate individuals (name and email) to occupy the following roles:
Title IX Coordinator
Investigator(s)
Informal Resolution Facilitator
Decision Maker(s)
Designation Details:
The investigator can be the coordinator.
The coordinator cannot be the decision maker.
The decision maker can be the investigator (if not the coordinator).
The informal resolution facilitator cannot be the investigator. This means if the Title IX coordinator is serving as the investigator, it cannot be the Title IX Coordinator.
Upon completion of the live training, each individual identified in the registration form, will be emailed the recording of the Zoom presentation. This recording will be available until Saturday, September 14th, 2024 at midnight. (No exceptions). If you wish to share it with additional individuals in your district, it is up to the Title Coordinator to disseminate the link accordingly before the expiration date.
All of the required training components will be met in this training.
IMPORTANT: Only one representative per district should complete the registration.
